Terms of Service

When you use our platform, TODO Boards, you are agreeing to these latest Terms of Service (“Terms”). Violation of these terms may, at our discretion, result in us terminating your account.

We may update these Terms of Service at any time. If we make significant changes, we will refresh the date at the top of this page.

Definitions

  1. “we”, “our”, or “us” in any of our policies or terms, refers to the owners of the TODO Boards web platform.
  2. “Service” refers to our web platform, TODO Boards.
  3. Finally, “you” or “your” refers to the people or organizations that own an account with our Service.

Account Terms

You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You may not use the Service for any of the following restricted purposes:

  • Breaking any laws or regulations
  • Attempt to deceive us or other users by making false reports or pretending to be someone else
  • Bypass, interfere with the security features of the Service, or attempt to overload/disrupt its operations
  • Harass or threaten other users or staff members

Additionally, we reserve the right to suspend, cancel or delete any account, at any time, without prior notice, at our discretion. You can report abuse/violation by contacting us via e-mail.

Uptime, Security, and Privacy

Your use of the Service is at your sole risk. We provide these Service on an “as is” and “as available” basis. We reserve the right to disable the Service at any time, without notice.

We take many measures to protect and secure your data through backups and encryption. We enforce encryption for data transmission from the public Internet. We use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services, as follows:

  • Render, for hosting of the web service
  • MongoDB Atlas, for all non-media data storage
  • Cloudinary, for storage of media content, such as profile pictures and user-uploaded media

You agree that we may process your data as described in our Privacy Policy and for no other purpose. On rare occasion, our staff may access your data for the following reasons:

  • To help you with support requests you make.
  • On the rare occasions when an error occurs that affects the operations of the Service, such as database errors. When we can fix the issue without looking at any personal data, we do. In rare cases, we may have to look at a minimum amount of personal data to fix the issue.
  • To safeguard the Service. If necessary, we may access accounts as part of an abuse report investigation.
  • To the extent required by applicable law, in the case of a legally binding order or proper request for data.

You agree that any data you upload to our Service to locations not belonging to your account, such as a board owned by a different user account that you have been given access to, will be stored indefinitely, without the option of deletion. This data can only be moderated, managed or deleted by the board owner account, or administrators designated by the board owner account. You always have the option to delete the personal information used for signing up for an account, and data uploaded in places belonging to your account, such as boards that you are the owner of. Copyright and Content Ownership

All content posted on the Service must comply with all applicable copyright laws. You have the right to notify us if you believe that a user account of our Service has infringed on your work(s) as a copyright owner. The notification must be written and sent to contact@todo-boards.com, and it must include the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work(s) claimed to have been infringed. If there are multiple, please share a representative list of those works.
  • A way for us to locate the material you believe is infringing the copyrighted work.
  • Your name and contact information, including an e-mail address, so that we can get back to you.
  • A statement that you, in good faith, believe that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

You give us a limited license to use the content posted by you and your users in order to provide the Service to you, but we claim no ownership rights over those materials. All materials you submit to the Service remain yours.

We do not pre-screen content, but we reserve the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the Service.

We own all right, title, and interest in and to the Service, including all intellectual property rights therein, and you obtain no ownership rights in the Service as a result of your use. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from us. Please email us requests to use logos or name. We reserve the right to rescind any permissions if you violate these Terms. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission.

Liability

You agree that we are not liable to you or to any third party for damages of any kind that result from the use of the Service, in ability to access data, or unauthorized access of your data or account. We are also not liable for damages of any kind related to actions of any third party that uses the Service, or any other consequences related to the Terms or Services.
